These Terms of Service (“Terms”) govern access to and use of the Aequitas legal and medical reporting platform (the “Service”), operated by Aequitas, a subdivision of TRIJ Ventures, Inc. d/b/a Kronos Health (“Aequitas,” “we,” “us”). By accessing the Service, you agree to these Terms. Where a separate written agreement or Business Associate Agreement (BAA) exists between your organization and Aequitas, that agreement controls in the event of any conflict.
1. The Service
Aequitas assists physicians and authorized parties in producing legal and medical reports, including history and physicals, narratives, permanency reports, maximum medical improvement reports, and independent medical examinations. The Service generates AI-assisted drafts of report content. The examining physician is solely responsible for reviewing, editing, and approving all clinical content and medical opinions. AI-generated drafts are not medical advice and are not a substitute for physician judgment.
2. Accounts & access
You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Access to case files is governed by the per-case permissions configured in the Service. You agree to access only the cases and information you are authorized to access.
3. Acceptable use
- Do not upload content you are not authorized to process.
- Do not attempt to circumvent security, access controls, or the audit trail.
- Do not use the Service in violation of applicable law or professional obligations.
4. Customer data
As between the parties, your organization retains all rights to the records, transcripts, and reports it submits or generates. You grant Aequitas the limited rights needed to process that content to provide the Service, consistent with the BAA and our Privacy Policy.
5. Disclaimers
The Service is provided “as is.” To the fullest extent permitted by law, Aequitas disclaims all warranties, express or implied. We do not warrant that AI-generated drafts are accurate or complete; physician review is required.
6. Limitation of liability
To the fullest extent permitted by law, Aequitas will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from reliance on AI-generated drafts that were not reviewed and approved by the responsible physician.
7. Governing law & jurisdiction
These Terms and any dispute arising out of or relating to these Terms or the Service are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You and Aequitas consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of New York for the resolution of any such dispute, and waive any objection to that venue.
8. Changes
We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.
